MiCA Crypto License in Denmark: Your 2025 Guide to CASP Compliance

Everything You Need to Know to Operate Legally in Denmark’s Crypto Market

As of 30 December 2024, the Markets in Crypto-Assets Regulation (MiCA) is fully applicable across the EU, including Denmark. Crypto-asset service providers (CASPs) must now comply with MiCA to legally operate. Denmark’s Financial Supervisory Authority (Finanstilsynet) oversees the application and enforcement of these new rules for the Danish crypto market.

But there’s more: the Danish FSA has also issued specific guidelines for DeFi platforms to clarify when an offering is truly decentralized and exempt from licensing under MiCA.

Here’s your complete guide to navigating these changes and securing your CASP license in Denmark.

MiCA Deadlines in Denmark

30 June 2024 – MiCA’s rules for EMTs (Electronic Money Tokens) and ARTs (Asset-Referenced Tokens) came into effect.
30 December 2024 – MiCA’s full scope applies; CASPs must obtain authorization to operate.
30 December 2025 – End of Denmark’s transitional period. Only authorized CASPs may legally provide services.

MiCA Compliance Checklist for Denmark

Register with Finanstilsynet (Danish FSA) for CASP authorization.
✔ Determine if your service is truly decentralized (otherwise, licensing is mandatory).
✔ Establish a real presence in Denmark with local management or representation.
✔ Meet MiCA’s capital requirements (€125,000–€150,000) and implement robust AML/CFT controls.
✔ Ensure Travel Rule compliance and real-time transaction monitoring for all crypto services.

What’s Unique About Denmark’s Approach?

  • DeFi & Decentralization Guidance: The Danish FSA warns that many projects calling themselves “decentralized” may not meet the strict criteria for exemption. If any identifiable party retains control over governance, smart contracts, or key infrastructure, licensing is likely required.

  • Real Presence Requirement: To apply for a CASP license, you need a substantial and operational presence in Denmark. This includes local offices, management residing in Denmark, and decision-making functions being performed locally.

  • Crypto Taxation Reforms Coming: Denmark plans to overhaul its crypto tax rules in late 2025. Expect inventory-style taxation for certain crypto-assets, ongoing capital gains obligations, and stricter reporting requirements for CASPs.
