User Agreement for on-demand report generation
- Introduction
This User Agreement ("Agreement") governs the use of on-demand report generation services, provided by Scorechain S.A., located in Luxembourg. By accessing and using the service via Telegram and completing payment via a payment processor accepting Credit Card payment, you agree to the terms outlined in this Agreement. This service provides real-time scoring information and a PDF report following successful payment. - Services Provided
The on-demand report generation services deliver real-time transaction analysis and generate a PDF report after payment (”the Report”). Reports cannot be regenerated; users will have access to the last report they generated, which will be historized in their account for future reference. - Payment and Fees
Payment is processed through an external payment processor, and by using this service, you agree to the payment processor's terms of service where applicable. All fees for the service are non-refundable, and once the report is generated, no further claims for refunds or reversals will be entertained. Payment is due at the time of service and must be completed to access the report. - User Conduct and Prohibited Uses
Users are strictly prohibited from:- Using the service or the information provided for illegal or unethical purposes, including but not limited to fraud, money laundering, or any other criminal activity.
- Reverse engineering, copying, redistributing, or modifying the service, including the scoring information and the generated reports.
- Using the generated reports for any commercial purposes. The reports are strictly for personal use.
- Liability Limitation
To the maximum extent permitted by law, Scorechain’s liability is limited to the amount paid for the service. Scorechain shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, or business opportunities. This limitation applies regardless of whether Scorechain was advised of the possibility of such damages. - Data Privacy and Security
Scorechain will store no user data. All information provided during the service interaction will be handled in compliance with GDPR, and no personal data will be retained after the service is rendered. - Termination
This service is a one-time transaction with no ongoing agreement between the user and Scorechain. The Agreement will terminate automatically after the service is completed and payment is processed. Scorechain reserves the right to deny access to the BOT service for any user found violating the terms of this Agreement. - Intellectual Property
All intellectual property related to the on-demand report generation services including the scoring system, software, and generated reports, is owned exclusively by Scorechain. Users are granted a limited, non-transferable, personal license to use the reports for personal purposes only. Any commercial use, redistribution, or unauthorized copying of the reports or scoring data is strictly prohibited. - Governing Law and Jurisdiction
This Agreement is governed by and construed following the laws of Luxembourg. Any disputes arising out of or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of Luxembourg. - Amendments to the Agreement
Scorechain reserves the right to amend this Agreement at any time. Users will be notified of significant changes, and continued use of the BOT after such modifications indicates acceptance of the updated terms. - Cancellation and Refund Policy
Under EU consumer protection laws, users acknowledge that the right of withdrawal does not apply to digital content provided on a non-tangible medium when the performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal. As the on-demand report generation service begins performing immediately upon payment by providing real-time data and generating a report, the right to withdraw from the transaction within 14 days does not apply. By completing the payment, users expressly consent to this immediate commencement of the service and acknowledge the loss of their right of withdrawal.
DISCLAIMER REPORT FOOTER
Scorechain operates under a best-efforts obligation, and the User acknowledges this. In no event shall Scorechain be liable for any loss of data, income, profits, or goodwill. Scorechain assumes no liability for the content of any Report, including but not limited to errors or omissions, or for any loss or damage arising from the use of the Report. The User agrees to evaluate and assume all risks associated with the use of the Report, including reliance on its accuracy, completeness, or usefulness. The User takes full responsibility for any decisions made based on the Report. Scorechain disclaims all liability to the fullest extent permitted by law. Scorechain shall not be held liable for any damages resulting from force majeure events, including but not limited to earthquakes, floods, storms, fires, epidemics, government actions, or service interruptions by telecommunications providers or electricity suppliers.
